A pair of homeowners lost their jury award when the jury found that the homeowners made misrepresentations regarding an insurance claim, resulting in the insurance policy being voided.
Back in 2009, the homeowners were dealing with issues regarding their kitchen drain. A plumber came to the home and took care of the drain line but there were still issues with the bathroom backing up, which the homeowners tried to correct. Using the help of a public adjuster the couple filed a claim with their insurance company.
After the insurance adjuster came to the home and investigated, the claim was denied in part because the homeowners stated that there was no toilet overflowing, the kitchen drain lines had been repaired and there was no water damage to the interior. Additionally, the insurance company found that there was no direct, accidental loss and as a result, no covered claim.
