An insurance company based in Deerfield Beach, Florida is generating headlines after suing many of its policyholders in Miami-Dade and Broward County for allegedly failing to follow the requirements outlined in their policy, according to a recent Sun Sentinel article.
After examining the several lawsuits, the Sun Sentinel noticed the majority of them are accusing policyholders of not allowing the insurance company to use its “preferred contractor” to take care of the damages that resulted in their claim. The contractor is a “Rapid Response Team” affiliated company implemented a few years ago.
The insurance company’s lawsuits allege that policyholders were aware they were signing a “preferred contractor endorsement” which allowed the insurer the right to exercise its “election to repair” and send out the Rapid Response Team for the purposes of making the repairs.
The lawsuits appear to be another example of the “assignment of benefits” situation. If you’re having trouble with your insurance claims or if you’re facing legal action, we can help you resolve your case. Give us a call today.
